THIS isn't just any potentially dangerous breach of health and safety rules.
It's a Marks and Spencer breach of healthy and safety rules, according to partially-sighted Leaming-ton campaigner Ian Foulds.
The Silver Birch Drive resident says he has now reported the store to the Health and Safety Executive twice in the space of a month.
First, a large sign was repeatedly put in the middle of the pavement Parade outside the Parade store, causing Mr Foulds to have several collisions.
Then contractors working on the shop front parked a van on the pavement, posing further problems for Mr Foulds.
He said: "Their van was obstructing the pavement and there were no cones, taped-off areas or workmen to warn the public of the hazard.
"My guide dog is trained to go between vans and shops to avoid going into the road.
"On this occasion I then banged into their stepladder, which was obstructing what was left of the pavement."
Mr Foulds produced his camera and snapped some photographic evidence.
The Health and Safety Executive has the power to prosecute serious breaches of regulations, which can result in substantial fines. In exceptional cases it can demand a site is shut down until made safe.
A Marks and Spencer spokeswoman said the shop had not heard from Mr Foulds directly, or from the HSE.
Sarah Hooker, the M&S Leam-ington store manager, said: "We are very sorry to hear that Mr Foulds has some concerns about the store.
"The health and safety of our customers is our number one priority and we check that contractors work in a tidy and safe way throughout their time here.
"Work is now complete but we have confirmed with the contractors that they must not park on the pavement. We would be very happy to speak with Mr Foulds if there is anything specific he would like us to look at."
Mr Foulds added: "My message to businesses is that it will no longer be tolerated. Safety breaches will be photographed and reported."
